Level Up powered by Agate (“we”, “us”) operates agatelevelup.com. We are committed to maintaining the trust and confidence of our visitors. In particular, we want you to know that we are not in the business of selling, renting, or trading email lists with other companies and businesses for marketing purposes.

In this Privacy Policy we explain when and why we collect personal information, how we use it, the limited conditions under which we may disclose it to others, and how we keep it secure.

What information do we collect?

  • Information about your visits to this website. Your IP address, approximate location, browser type and version, operating system, referral source, length of visit, page views, and website navigation. Most of this is collected through analytics tools only after you agree to analytics cookies — see our Cookie Policy.
  • Information you give us. For example your name, email address, phone number, company, and message when you submit our contact form; or your name, email address, company, and industry when you request an e-book or case study. For RCD Library access requests, we collect the authorized signer’s name, work email and job title, the company’s legal name, country of incorporation and registered address, and your authority/privacy confirmations.
  • Gamification guide. Your draft answers are kept in this browser tab for up to two hours after the last update. When you choose to send a brief, we collect your answers, project notes, name, company, work email and optional phone number to discuss the project with you. Contact details are not kept in the browser draft, and sending a brief does not request an NDA or subscribe you to marketing.
  • Any other information you choose to send us.

Before you disclose to us the personal information of another person, you must obtain that person’s consent to both the disclosure and the processing of that personal information in accordance with this policy.

How we use your personal information

Personal information submitted to us through this website is used for the purposes described in this policy. We may use it to:

  • administer the website and keep it secure;
  • improve your browsing experience;
  • respond to your enquiries and complaints;
  • send you the content you request — for example an e-book download link by email;
  • send you general (non-marketing) commercial communications;
  • send you notifications and communications you have specifically asked for;
  • contact you about related services and updates where you have given your consent — for example, through the marketing consent checkbox on our e-book form;
  • prevent fraud and spam — for example, our forms are protected by Cloudflare Turnstile;
  • understand how the website is used so we can improve it — where you have given consent.

We will not, without your express consent, provide your personal information to any third party for the purpose of direct marketing.

Analytics and advertising

We use analytics tools (Google Analytics 4 and Microsoft Clarity) to understand how visitors use the site — which pages are popular and where we can improve. These tools are loaded only after you accept analytics cookies. We do not send names, email addresses, or other direct identifiers to analytics tools; events are classified (for example “service interest: gamification”), never with your personal details.

If we run advertising campaigns (for example on Google, Meta, or LinkedIn), conversion measurement will also run only after you accept marketing cookies, and will be managed centrally through a tag manager (Google Tag Manager). See our Cookie Policy for the full list of cookies and how to change your choice.

Email communications

We use RCD Library request details to review the request, prepare the confidentiality agreement and contact the authorized signer. Submitting an access request does not itself sign an NDA, activate access or subscribe you to marketing. Our team receives an internal notification through Resend. Where a signing invitation is issued, the NDA is processed through our self-hosted DocuSeal service; the signing record is maintained separately from website analytics. We do not send your name, email or registered address as analytics event parameters.

When you send us a message or request a download, we use your details to reply and to provide what you asked for. Automated emails from this website are delivered through a third-party email service provider (Resend). Follow-ups from our team may be sent personally from our company email accounts (Microsoft Outlook). Where you have given marketing consent — for example through the checkbox on our e-book form — we may also contact you about related services and updates; you can withdraw that consent at any time. We don’t rent or trade email lists with other organisations and businesses. You can ask us to stop contacting you at any time via the contact form.

Disclosures

We may disclose your personal information to our employees, officers, agents, suppliers, or subcontractors where reasonably necessary for the purposes set out in this policy. We may also disclose it to any member of our group of companies (our subsidiaries, our ultimate holding company, and its subsidiaries).

In addition, we may disclose your personal information: to the extent that we are required to do so by law; in connection with any ongoing or prospective legal proceedings; and in order to establish, exercise, or defend our legal rights (including providing information to others for the purposes of fraud prevention and reducing credit risk).

Except as provided in this policy, we will not provide your information to third parties.

Third-party service providers

We rely on a small number of trusted services to run this website. Depending on how you use the site, they may process limited personal data on our behalf:

  • Cloudflare Turnstile — protects our forms from spam and abuse.
  • Resend — delivers the emails we send in response to form submissions and download requests.
  • Microsoft 365 (Outlook) — our business email service, used when our team follows up with you personally.
  • Google Analytics 4 and Microsoft Clarity — measure website usage, only after you consent.
  • Google Tag Manager — manages measurement and advertising tags centrally.
  • Our hosting providers — serve the website and store form submissions securely.

Each provider is bound by its own terms and privacy commitments, and we only share what is necessary for the service to work.

Security of your personal information

We take reasonable technical and organisational precautions to prevent the loss, misuse, or alteration of your personal information. Data you provide is stored on secure, password- and firewall-protected servers, and all communications with this website are protected by encryption (HTTPS). However, transmitting information over the internet involves many factors and end-to-end points that are outside our control, so we cannot fully guarantee the security of data sent over the internet.

Your rights

Depending on where you live — including under the GDPR (EU/UK) and Indonesia’s Personal Data Protection Law (UU PDP No. 27/2022) — you have the right to request access to, correction of, or deletion of the personal data we hold about you, and to object to or restrict certain processing. To exercise any of these rights, contact us through the contact form. We may ask you to provide appropriate evidence of your identity before we act on your request, and we may withhold information where the law permits or requires it.

This policy does not cover the links within this site that lead to other websites. Those sites are not governed by this Privacy Policy, and if you have questions about how a site uses your information, you’ll need to check that site’s privacy statement.
